TERMS AND CONDITIONS

1. ACCEPTANCE BY ORDER:

Please read the following terms and conditions carefully before using Sharlin Data Systems or our website. By sending an order or the use or downloading of materials from our website you agree to be bound by these terms. The information contained or referred to our web site comes from a variety of sources and may not be accurate, complete, or up-to-date. This information is provided on an "as is" basis.

2. SHIPPING AND DELIVERY:

Upon notification to Sharlin Data Systems that payment has been made and cleared, the goods shall be delivered by the agreed carrier at the Customer’s risk.

Upon receipt of payment Sharlin Data Systems will endeavour to despatch goods within three working days. If an item is unavailable at the time of ordering you will be notified by one of our account sales managers.

Once the order is ready for despatch, Sharlin Data will use the services of COPE sensitive freight to distribute goods nationally.

When the goods have been picked up by COPE, you will be e-mailed with the freight shipping number, to enable tracking of the goods.

Dependant on location, the standard delivery service can take between 1 and 3 working days.

If the order is urgent, you may choose an overnight service for an additional charge. Standard road - Allow 1 to 3 working days $30.00 inc GST.  Overnight service $75.00 inc GST.


3. PAYMENT:

The preferred payment methods are Direct Bank Deposit, Cheque or Money Order. Cheques and Money orders can be mailed to: Sharlin Data Systems 5 Ingham Way Salisbury Heights SA 5109.
In the event that Sharlin Data is required to engage the service of any mercantile agency to effect collection of any amounts overdue to Sharlin Data then all collection expenses and associated charges shall be borne by the purchaser.

4. LIABILITY:

In no event shall Sharlin Data Systems be liable for any special, indirect or consequential damages whatsoever, resulting from the loss of use, data, or profits, either in an action of contract, negligence or other tortuous action arising out of or in connection with the use of product or information supplied by Sharlin Data Systems.

5. FORCE MAJEURE:

Contracts and deliveries may be suspended by Sharlin Data Systems in the event of any strike, lockout, trade dispute, fire tempest, breakdown, riot, theft, crime, civic disturbance, war, legislation, force majeure, the inability of Sharlin Data Systems to procure necessary material or articles preventing or retarding performance of the contract of delivery or work and no responsibility shall be attached to Sharlin Data Systems for any delay, default, loss, or damage due to any of the above causes or to any other cause beyond the control of Sharlin Data Systems.

6. QUOTATION TIMEFRAME:

All Quotations are valid for 14 days. In the event that Sharlin Data Systems does not receive notification of a customer’s acceptance of the quotation within that timeframe, the quotation will lapse and become null and void. Quotations that have lapsed must be re-quoted taking into account any changed circumstances.

7. PRICE AND PRODUCT AVAILABILITY:

All quotations for products not commonly stocked or for new hardware orders are subject to availability and fluctuations in the Australian dollar against the US dollar. Sharlin Data Systems reserve the right to modify quoted prices and products as necessary in conjunction with the customer as a result of such issues considered beyond our control.

8.WARRANTY:

All new products are subject to twelve (12) months ‘Parts and Labour’ manufacturer’s warranty (unless otherwise specified). All ‘Out of Manufacturer Warranty’ repairs are subject to ninety (90) days warranty from date of invoice for defects not caused by accident or negligence (not including power supplies and cables). Freight costs associated with the warranty process are the customers’ expense.

9.GST:

Unless otherwise stated, all prices are quoted inclusive of ‘Goods and Services Tax’ (GST).

10. CONDITIONS OF CREDIT RETURN & SERVICE REQUESTS:

A Return Authorization (RA) number must be issued before returning goods to Sharlin Data Systems for all returns. Except for faulty, damaged on delivery, or incorrectly supplied goods, a 20% handling/restocking fee will be applied to all goods returned for credit. Claims for credit must be made within seven (7) days of delivery. Credit will NOT be issued for freight content of original invoice.

An Inspection fee of A$80 Inc GST will apply if warranty goods are tested and no fault found. If a Customer makes a special order, where Sharlin Data Systems has bought in goods on the customer's request for non-stock items or orders for bulk quantities, credit on these goods will be rejected. Goods that are returned for credit must be in full re-saleable condition - returned in original packaging. Both external and internal packaging must be complete and in original state. Writing and stickers on external packaging will NOT be accepted; therefore the return claim will be rejected. Freight and Insurance of returned goods to Sharlin Data Systems are at the customers cost and returned at the customers' risk. Sharlin Data Systems will return the repaired/replaced goods to the Customer freight prepaid.

These terms and conditions are to be read subject to mandatory provisions of legislation of the Commonwealth of Australia including the consumer protection provisions of the Trade Practices Act 1974 or of one or more of the States or Territories, which afford statutory rights to consumers. The invalidity of any clause, or part of a clause, shall not affect any other clause or other part of the clause.
